Do Not Call Procedures
Power Direct is committed to demonstrating to our clients that the outsourcing decision
is as low-risk as possible. Many internal operations do not have the resources to ensure
proper compliance with all related legislative requirements. At Power Direct, we utilize
several methods to ensure strict adherence to all federal and state laws.
Power Direct has hired a law firm that specializes in compliance to telemarketing legislation.
Issues, questions, and review of compliance procedures are directed to the law firm for evaluation and counsel.
To ensure compliance to DNC regulations, Power Direct employs a third party DNC vendor to scrub
our lists against state and federal DNC lists.
Power Direct reviews its policies and procedures with legal counsel on a scheduled basis.
Proactive notification of legislative change is communicated by both our third party DNC
vendor and our legal counsel to allow Power Direct ample time to plan for and comply with
anticipated changes.
Additionally, Power Direct has an internally assigned Compliance Officer responsible for
proactive review of current projects as well as industry information pertaining to federal
and state legislative activity.
The entire Power Direct leadership team attends seminars, training, and continuing education
through review of industry periodicals. Compliance is a standard topic at our monthly business
review sessions.
Third Party Verification
Power Direct has partnered with DNC Solutions to verify that all Power Direct client data is authenticated with the DNC List from the individual states. Databases supplied by our clients are sent to DNC Solutions to be scrubbed against all state DNC lists. DNC Solutions also performs constant maintenance and upgrading of these lists to ensure compliance with the individual states where these regulations are required.
Internal DNC Procedures
Power Direct also employs internal “do-not-call” procedures. When requested by the customer, our TSR’s are instructed to status any specific record(s) as “Do Not Call”. These records then become part of our internal DNC list and are scrubbed against all subsequent and existing databases received from the client.
TSR Training
Power Direct’s TSR training integrates state mandated, federally mandated (TCPA), and internal “do-not-call” procedures. This training includes the enforcement of a company policy regarding DNC procedures and guidelines for the maintenance of the client’s DNC list. These guidelines also provide for the recognition and incorporation of state generated DNC lists. Power Direct will also monitor all calls made on behalf of our clients in order to provide detailed records for determining the time and number dialed for all individual consumers. In addition, Power Direct also trains employees on internal policies regarding compliance with all relevant telemarketing laws including the FTC’s Telemarketing Sales Rule and similar state telemarketing statutes.
